What documents do I/We need to submit at the time of booking of Unit?

Docs required in case of booking in name of an individual(s)

  • Self-attested photocopy of the pan card or duly filled and signed Form 60 along with the address proof in case you do not possess a pan card
  • Duly filled and signed application form
  • Booking amount payment in Indian Rupees

Docs required in case of booking in the name of the company:

  • Memorandum and Articles of Association of Company
  • Original board resolution authorizing designated signing authority for signing relevant documents on behalf of your Company pertaining to the Unit
  • List of Directors and Shareholders of Company
  • Attested photocopy of the pan card of the Company
  • Duly filled, stamped and signed Application Form
  • Booking amount payment in Indian Rupees

Docs required in case of booking in name of a partnership firm:

  • Notarized photocopy of Partnership Deed
  • List of partners of Partnership Firm
  • Attested photocopy of the pan card of Partnership Firm
  • Duly filled, stamped and signed Application Form
  • Booking amount payment in Indian Rupees
What documents do I/We need to submit incase I/We wish to mortgage the Unit?

Please submit the following documents for issuance of loan documents for your unit

  • Signed request letter from all the allottees conveying the name of the Loaning Institution, the branch you wish to take a loan from and its address.
  • One original set of Allotment Certificate & Agreement duly signed by all the allottees on all pages, if not submitted earlier
  • Self-attested photocopy of Pan Card of the allottees, if not submitted earlier.

Please Note: The signed TPA (Tri Partite Agreement) and NOC/Permission to Mortgage (PTM) will be forwarded only after receipt of the above documents. The photocopy of TPA signed by all the allottee/s signed & stamped by the bank on all pages needs to be sent to the company for its future reference & records.

What procedure I/We need to follow for addition/deletion/substitution of a name in my/our Allotment Certificate and Agreement of the Unit?

Addition/deletion/substitution of the name in the Allotment Certificate & Agreement can only be done within a family (defined herewith as Husband, Wife and their Children) and on completion of the documentation as mentioned below:

Requisites for Name Addition /Name substitution
  • Request letter for name addition/substitution duly signed by all the allottee/s
  • Signature verification by the bank of New & all old Allottee/s.
  • Request letter on plain paper requesting for name addition/substitution from the person(s) desirous to be included/substituted in the unit as owner/co-owner
  • Affidavit in the prescribed format (to be downloaded from the below link) is to be given by all the old allottee/s. In the case of Indian Resident, the affidavit is to be given on Rs.10/- non-judicial stamp paper duly attested by the notary public. In case of NRIs,' the affidavit is to be given on the plain paper and duly attested & stamped by the notary public of state/country they are residing in.
  • Allottees' set of signed original Allotment Certificate & Agreement
  • No objection Certificate from loaning institution, in case the unit is mortgaged
  • Administrative Charges with service tax (contact our customer care team for details)
  • Self-attested pan-card/s of New allottee/s or duly filled and signed Form 60 along with the address proof in case he/she do not possess a pan card
  • In case of Name addition/substitution is to be done for any property booked at Eldeco Green Meadows, Greater Noida, then an additional affidavit in the prescribed format (Can be downloaded from the below link) is to be given by the new allottee(s) whose name is proposed to be added in the Allotment Certificate and Agreement.

Requisites for Name Deletion
  • Request letter for name deletion duly signed by the allottee/s whose name is/are required to be deleted.
  • No objection letter duly signed by all the allottee/s whose name will continue in the Allotment Certificate and Agreement.
  • Affidavit in the prescribed format (Can be downloaded from the below link) is to be given by the allottee whose name is being deleted. In the case of Indian Resident, the affidavit is to be given on Rs.10/- non-judicial stamp paper duly attested by the notary public. In case of NRI's the affidavit is to be given on the plain paper and duly stamped & attested by the notary public of state/country they are residing in.
  • Allottees' set of signed original Allotment Certificate & Agreement.
  • No objection Certificate from loaning institution, in case the Unit is mortgaged.
  • Signature verification by the bank of all the allottees i.e. all the remaining allottee/s and the allottee/s whose name is/are required to be deleted.
  • Administrative Charges with service tax. (contact our customer care team for details)

Please Note: All the pages of the affidavit are to be signed. Further, the affidavits should be completely typed with complete details without leaving any blanks. In case any blanks are left and later details are handwritten then allottee/s needs to necessarily countersign at all such places. The addition/deletion/substitution would be executed in 4 working days upon receiving all the above documents and realization of payments.

What is the process in case I/We want to sell/transfer my/our Unit Post-registration of Sale/Sublease Deed?

Transfer of the property can be done after registration/possession of the Unit. The transfer procedure/documentation is detailed below (Can be downloaded from the below link):

  • Clearance of outstanding payments of maintenance charges, power back up dues, etc. and Original NOC from Association of the allottees of the project ("RWA") in which the subject unit is located to that effect, in case of existing RWA.
  • Submission of a request letter in original, signed by all the Allottees/ transferor with their complete details [S/o.D/o.W/o_____ (with address)], issuing NOC for transfer in favour of transferee/buyer with full details [S/o.D/o.W/o_____R/o._________ (with address)]
  • Submission of an undertaking in original, signed by the transferee (signed by all joint allottees) with their full details [S/o.D/o.W/o_____ R/o._________ (with address)], that they (transferee/s) would be liable to pay all the maintenance & fixed dues, from the date of issuance of NOC by the transferor Allottees.
  • Original car parking usage letter(s) and storage/utility space usage letter(s) earlier issued in favour of transferor allottees at the time of possession.
  • Original NOC from loaning institute (in case of the subject unit is mortgaged) or Loan Closure letter.
  • Administrative charges with service tax (Kindly contact our customer care team for details)

Please Note: The NOC would be issued after three working days of submission of all the above-mentioned requirements and realization of the payments made. The change in title in our records would be updated only upon receipt of the copy of the transfer memorandum for leasehold properties from the concerned authority. For other than leasehold properties please provide the notarized photocopy of sale/transfer deed.

What are the pre-requisite/formalities for possession of the Unit?
  • Clearance of all payments (extra charges, legal, incidental charges & stamp duty payment, etc) as mentioned in the Final Demand Notice/Offer of possession (FDN) in line with the stipulated period mentioned in the FDN.
  • Clearance of outstanding of interest, holding charges, maintenance charges, power back up dues, etc. till the end of the month in case the possession of the unit is delayed beyond the stipulated period mentioned in the FDN
  • 24 post-dated cheques towards maintenance charges as per the FDN and cheque towards RWA membership as per FDN
  • One original copy of Allotment Certificate & Agreement and original addendums (if any) duly signed by all the allottees on all pages, if not provided earlier
  • Self-attested photocopies of Pan cards for all the allottee/s, if not provided earlier
  • The signing of the Company's standard possession documents & agreements duly witnessed.
  • Additional requirements to comply in case the unit is mortgaged
  • Please submit the original NOC from the loaning institution.
  • Please ensure to submit the photocopy of TPT signed by all the allottees, signed & stamped by the bank on all pages, if not provided earlier.
  • Signature verification by the bank of all the allottee/s.

Please Note:

  • The final finishing of the Unit will be executed only upon realization of all payments (extra charges, legal & incidental charges, stamp duty payment, revised interest, holding charges, maintenance charges, power back up dues, etc..) as mentioned in the FDN.
  • It generally takes 20-25 working days to organize registration at concerned authority, post receipt of all payments & compliance of all other pending formalities of the unit.
  • The possession of the Unit would be done only after registration of the sublease/conveyance deed. Meanwhile, allottee(s) can do a pre-inspection of his/her/their unit and signing the possession papers
When will my Maintenance period start?

The maintenance period will start from the actual date of physical possession of the subject Unit or from the date as mentioned in the Final Demand Notice, whichever is earlier.

What are the likely Stamp duty charges on Sale/Sublease Deed?

Stamp Duty is payable on the consideration of the Unit or at the prevailing circle rate of the unit (notified by the competent authority of the state in which the unit is located), whichever is higher, at the stamp duty rates prevailing on the date on which registration of the Sale/Transfer/Conveyance deed will be executed.

The stamp duty amount does not include Registration fee which will be intimated in the Final demand notice. The Stamp Duty rates may be revised by the competent authority.

Can I/we give Power of attorney (POA) for the execution of the registry &/or for signing possession documents on my/our behalf?

In case you are in India you can authorize your spouse/blood relative to execute the registry &/or sign possession documents on your behalf by executing the Power of attorney in his/her/their name:

  • Prepare the POA (to be downloaded from the below link) on Rs. 100/- non-judicial stamp paper purchased in name of the executants of the POA.
  • The duly filled POA (without blanks or handwritten text) needs to be signed by all the executors on all pages.
  • The POA needs to be registered either at the registrar/sub-registrar office where the executants/s inhabits or at the office of registrar/sub-registrar office, where the project in which the subject unit is located.
  • The POA holder would be required to carry the original POA for the registry.
  • A notarized photocopy of the POA needs to be submitted at the HO of the Company.
  • In case you stay abroad you can authorize anyone to execute the registry &/or sign possession documents on your behalf by executing the Power of attorney in his/her name:
  • The duly filled POA (without blanks or handwritten text, as per format to be downloaded from the below link) needs to be printed on a plain paper and signed by all the executors on all pages; attested by the consulate of India at your state/country.
  • The POA holder has to get the POA stamped with AIG stamp of the area in which the Unit is located, if applicable..
  • The POA holder would be required to carry the original POA for the registry.
  • A notarized photocopy of the POA needs to be submitted at the HO of the Company.

Please Note: The norms w.r.t. the execution/registration of POA prevailing as on the date of execution/registration of POA in the jurisdiction of the project in which the subject unit is located and/or applicable in the executing court would also be applicable.

What documents do I/We need to carry along for registration of the Unit on the date of registry?

The documents required at the time of Registration of the Sublease/Conveyance Deed are as under:

Indian Residents:

  • 4 passport size photographs for each of the allottees
  • Passport/Photo ID proof in original
  • Copy of PAN Card
  • Signature & photo attestation for all the allottees from bank

Hindu Undivided Family:

  • Copy of PAN Card of HUF
  • 4 passport size photographs of authorized signatory
  • Signature & photo attestation for all the allottees from bank

Partnership Firm:

  • Copy of PAN Card of the Partnership Firm
  • Notarized photocopy of Partnership Deed
  • 4 passport size photographs of all the partners
  • Signature & photo attestation for all partners from bank

Company:

  • Copy of the PAN Card of the Company
  • Attested photocopy of MOA of the Company
  • Board resolution authorizing the signatory to sign the documents related to purchase and registration property on behalf of the Company
  • List of Directors and Shareholders of the Company
  • 4 passport size photographs of authorized signatory
  • Signature & photo attestation for signing authority for the company from bank
Can I/We authorize someone to take physical possession/keys of my/our unit on my/our behalf?

You can authorize your family members to take physical possession of the Unit on your behalf by executing the letter of authority as per the attached format in his/her name.

What all documents do I/We need to carry to site at the time of taking physical possession of the Unit?

In case either of the Allottees (authorized signatory in case of the partnership firm or company) is taking the physical possession of the Unit, they need to carry along the original possession certificate/letter & car parking usage letter, storage/utility space usage letter issued by the Company.

(P.N. If you are authorizing family members/friend to take physical possession of the unit then they have to carry the original letter of authority to the site along with the aforementioned documents)
